Diaz grew up in the house in question with his mother, Betty D'Nodal. The house in the Bronx, New York was part of a divorce settlement where Betty bought out her ex-husband and received a new mortgage from the bank in 2002. This led to an expanded mortgage payment, and Betty dealt with that with a couple refinances (this was the time and the season for such things). Then she fell ill, one of the recurring themes in these foreclosure stories - the cost of catastrophic medical bills being the start of all the problems.
Betty's mortgage got sold to HomeEq servicing and they decided not to accept her payments anymore, until she resolved some late payments that carried over fro the prior servicer. They would not accept anything but a wire transfer. This tenuously worked for a couple years. Then, she wound up with a tenant who stopped making rent payments on the home. Due to New York tenant laws it took a year and a half to evict her, and the drop in income plus the legal fees caused her to fall behind on the mortgage. HomeEq servicing began foreclosure proceedings and said they wouldn't stop them until she made a $ 10,000 penalty fee. Betty managed to pull that together, moving her from in foreclosure to merely delinquent.
This has continued for years, with Betty a month or two behind in her payments, and falling behind in her other bills in order to stay at that point. The servicer wasn't willing to provide a modification, and she wasn't interested in HAMP.
That's when her son found out about NACA, through my reporting on them. Eventually, Betty signed up for the program, and they evaluated her for it in early January. They walked her through a meeting with her income statements, and worked with a servicer, by this time Ocwen, to arrive at a modification she could afford. NACA yesterday provided an estimate of the savings - a $ 900 reduction per month - and said that the approval should come in the next 30 days. Ocwen had been operating in good faith to find a solution for Betty, including knocking out late fees that HomeEq tacked onto the loan which raised the payment $ 300 a month on their own.
